DENVER —The Libertarian Party of Colorado had a hearing in District Court yesterday to place Sean Vadney on the November ballot as the Libertarian nominee for Secretary of State, after Alex Astley withdrew his candidacy. Today, the Court ordered the Libertarian Party candidate Sean Vadney to be placed on the November General Election Ballot.
On August 31, 2026, representatives of the Libertarian Party of Colorado had submitted forms to the Secretary of State designating Sean Vadney to fill the candidate vacancy, but those forms were denied due to the date of Alex Astley’s withdrawal being one day outside the period for withdrawal described in C.R.S. § 1-4-1007.
The court ruled that the Code should be liberally construed to ensure all eligible electors are permitted to vote and ineligible electors are prevented from doing so. C.R.S. § 1-1103(1). Substantial compliance with the provisions or intent of this code shall be all that is required for the proper conduct of an election. C.R.S. § 1-1-103(3).
At the hearing, it was concluded that the one-day delay in the candidate withdrawal would not prevent the Secretary of State Office from performing any statutory duty related to ballot preparation.
The Libertarian Party reaffirmed its commitment to running and supporting Libertarian candidates and providing voters with a genuine principled choice.
