April 2010 | Vol 39 Issue 4

  From The Chair

The Libertarian Party of Colorado just had a tremendous 2010 convention.

We nominated candidates for U.S Senate, U.S. Congress, Governor, Lt. Governor, Colorado Senate, Colorado House, CU Regent and county commissioners from Boulder to Mesa County. (Click here for more details).

For the first time, we will have a state wide primary election. It will be on Tuesday, August 10, 2010. We had candidates get at least 30% of the vote in three important elections at the convention. According to state statute, we must have a primary for those three nominations.

While primaries are a waste of taxpayer money (there is no reason each party should not pay for its own selection of candidates), we are forced to participate by law. Therefore, we will take full advantage of the process to spread the message of small government.

I have already heard the same tired nonsense about how we will sabotage the election of members of the Big Government duopoly . The arrogance behind that ridiculous assertion is astounding. Members of the two-party duopoly assume every vote belongs to them, and any attempt to change the status quo is blasphemy.

As you know, Libertarians do not vote for Big Government politicians. Every Libertarian vote is a vote AGAINST Big Government politicians of every stripe, from Barack Obama to George W. Bush to Bill Ritter to Bill Owens. The notion that every third party vote would have otherwise gone to the Big Government Duopoly is absurd. We offer voters that would otherwise stay home an alternative: Freedom.

Even if the assertion were true, it is beside the point. Members of the two-party duopoly make the rules. Plurality voting works for them to maintain a grip on power and it discriminates against third parties that actually have principles. Plurality voting is not in the Constitution. Neither is the two party system. Both can - and must - be changed.

If they think we can "spoil" an election, let them think so. For instance, if a Green Party candidate got 2% of the vote in a given race, and the Republican beat the Democrat by 1%, let the Democrats cry and whine. Then point out to them that they make the rules, and if they do not want their elections "spoiled" then they can adopt a different system, like Approval Voting. "Spoiling" an election is impossible under approval voting.

It is never a third-party's "fault" if they play by the rules forced on them by those in power. I hope every race between the Big Government Democrats and the Big Government Republicans is decided by a margin smaller than the number of votes received by a third party. Then maybe those in power will realize it is in their best interest to change the voting system.

"Always vote for principle, though you may vote alone, and you may cherish the sweetest reflection that your vote is never lost."

And Let Freedom Ring.

With the help of El Paso activists, I organized a well-attended meet and greet in Colorado Springs on March 16. Thank you to all the local activists and Board members who were able to attend and support this effort to create a new affiliate. I am following up with local activists with the intention of organizing El Paso Libertarian Party support for Libertarian candidates as well as taking advantage of upcoming outreach opportunities.

We currently have active affiliates in Arapahoe, Boulder, Jefferson, Larimer, Delta and Saguache Counties, with nascent groups in Garfield and El Paso. We also have a campus affiliate at Colorado State University. My next goal is to organize a meet and greet in Denver with the intention of forming a strong affiliate there. Douglas County is also high on my list of potential future affiliates. As for campus affiliates, the Colorado School of Mines is likely my next target. I'd like to appeal to anyone who lives in Denver, Douglas or any other county without an active affiliate to contact me. We can work together to organize activists in your county.

  Campaigns Report
 By Norm Olsen, Campaigns Director
It was a great honor for me to put the following 25 names in nomination for public office under the Libertarian label. While our numbers are substantially less than some of our previous efforts, I'm convinced that in terms of quality, this is the best slate we've run since I started doing this sort of stuff 12 years ago.

These candidates will be working very hard bringing the message of individual freedom and limited government to over three million Colorado voters. The audience will be more receptive this year than any other. Please, please, support these candidates in every way, and as much as, you can.

  F.R. Outreach Report
 By Jeff Orrok, Outreach Director
I am looking for someone to succeed me as Outreach Director when my term ends at the State Convention on March 20. Please, email the board at Board@LPColorado.org.

As of March 1, there are 8,146 active and 3,825 inactive for a total of 11,971 registered Libertarians in Colorado. Last month's adjusted growth rate (normalized to a 30 day period) is 1.18% and the projected annual growth rate is 15.30%. I have submitted a CORA request for a price quote to obtain a list of Libertarians registered since the SOS dump. To actually obtain the information will cost at least $25, and I will provide the exact amount quoted to me in a supplemental email. Most of our registrations do not come through our VRD, and I believe that it is important for us to contact new members to welcome them and get them involved.

Speaking of VRD's, as I mentioned in last month's supplemental report, after a grueling wait at the Capitol, I testified against SB10-104 "additional VRD requirements" late in the evening on Feb 11 along with a few other VRD organizers (Common Cause, New Era Colorado, and a latino organization whose name I didn't get). The bill was killed in the State Military & Veterans Affairs Committee along party lines (yes, we actually have something to thank Democrats for).

Thanks to Mike Spalding for submitting names of activists for The Lights of Liberty Award by The Advocates for Self-Government. Honorees receive a certificate and a coupon for 40% off of purchases from The Advocates. The LPCO and its county affiliates would be grateful for donations of those coupons (AND the money to spend on literature and quiz materials).

We urgently need $1000 for booth fees ASAP!
Due to lack of funds, we missed the deadline for the early registration discount for Pridefest. Van's Warped Tour tickets go on "pre-sale" on March 26. Thanks to Dan "Kilo" Sallis, for stepping up and donating the funds needed to buy six tickets.

I am starting to receive reminders to register for events such as Cinco De Mayo, Peoples Fair, and Pridefest, but due to our lack of funds, I am unable to submit applications. Click here to donate $1,000.00 for a Libertarian Party presence at these festivals.

I have made no further progress on the college, high school, and speakers bureau programs.

  Media Report
 By Kate Melvin, Media Director
If there is one message that has resounded with the mainstream media following our state convention it's this: The Libertarians are back with a vengeance! Following the announcement of our candidates who were nominated at the convention (view the release here), we saw an overwhelmingly positive media response.

When talking with reporters from The Denver Post, The Colorado Statesman, the Longmont Times-Call, The Colorado Springs Independent and others, it became clear to me that the mainstream media is once again paying attention to our party. Perhaps it is the momentum of the Tea Party movement that has forced them to cover outside the R's and D's, but our outstanding nomination of nearly two dozen candidates at the local, state and federal levels cannot be ignored.

  Membership Report
 By Clint Jones, Membership Director
Listed below are the accomplishments of the Membership Director for 2009:

I gave packets of marketing collateral to Board members and others to have available if people were interested in and wanted more information on the Libertarian Party.

I met with two Libertarian contributors in August, 2009 to ask for financial support of LPCO and received $700 at a time that the LPCO finances were at a low.

In August, 2009, I attended 2 town hall meetings held by Congresswoman Diana DeGette on the health care bill. In the first, held in Englewood during the day, most people were against this monstrosity. The second, held on Saturday at South High, was well attended with 75% for the bill. I asked if the bill required citizens to buy health insurance. Diana said yes. When I then asked what happened to freedom in our country, I was booed by 20-30 people.

I drafted a bare monthly budget for LPCO and approximate costs for purchasing electronic upgrades and marketing collateral.

I worked with the National Libertarian Party Treasurer to get a good count of Colorado subscribing Libertarians, Libertarians that supported National with at least $25/year. With this new count, Colorado moved into the top 10 states with subscribing supporters and we got another CO Libertarian on the National Platform Committee.

I drafted a script for use in calling Colorado registered Libertarians and gave that script to 10 volunteers to use. Those volunteers contacted about 800 voters (500+ by John Finger) using that script to gain deeper support from the 11,000 registered Libertarian voters in Colorado.

During 2009, I used that script and made 1000 phone calls to registered Libertarian voters in Denver County. Reaching about 600 to talk with, 200 were added to the CO Liberty newsletter list, and some of those voters answered affirmatively to contributing support in donations or yard signs for Libertarian candidates who may run in their district.

This was my focus for 2009 – to increase the number of active and contributing people to both the State Libertarian Party and the affiliates of the State Party. Yet with all these contacts, only a few of the 600 I reached have moved forward so far with actual support. I will be contacting them again in 2010.

  Western Slope Report
By Debbie Schum, Western Slope Regional Director
It's been a busy time for Libertarians, and for those of us on the western slope of Colorado as well!

The name of the western slope outreach director position has been changed to western slope regional director, to reflect the greater variety the position holds, beyond outreach.

2 Libertarians are running for county commissioner offices in western Colorado...Gary Johnson (www.johnson4commissioner.com) in Delta County and Steve Saint in Mesa County.

We also have a Libertarian candidate for the 3rd congressional district, which covers the entire western half of the state (and then some), Greg Gilman. I am working as best I can with all 3 of these candidates.

Thank you for your help in the 3 state wide petitions regarding car registration fees, property taxes, and state/local debt. Those initiatives are now on the November ballot as Amendments 60 and 61, and Proposition 101 (see www.cotaxreform.com for more information and to volunteer). The battle is not over. We need help getting signs put up and fliers handed out. Please email me at wsoutreachdirector@lpcolorado.org for an attachment of the fliers, or info@cotaxreform.com. These are important ballot initiatives!

Hope to see many of you at the National Libertarian Party convention May 28th, 2010 in St. Louis. I have joined the national platform committee, and intend to be there as well.

I have had calls and emails from a large number of brand new Libertarians in western Colorado interested in running for office, meeting other Libertarians in their counties, and becoming involved in activism. I want to welcome you all aboard, and thank you for your interest in changing our cities, counties, and state back to rationality.

In the months ahead, we on the western slope plan to focus on getting our candidates into parades, debates, forums, interviews, and heard in whatever venues we can elbow our way into. We plan to organize regionally quarterly (as well as the usual monthly meetings for affiliates). And we plan to be seen and heard!
  Letters To The Editor:
The Destruction Of The Constitution - By Michael Connelly

What many Americans have feared for years may be about to come to pass. We have an out of control Congress and an arrogant, elitist President who believes it his destiny to transform the United States from a republic to a socialist system of government where individual freedoms are severely restricted. Congress is preparing to give the President and his Executive Branch of government what amounts to dictatorial powers over one-sixth of our economy and the private health care decisions of everyone who lives in the United States.

Congress is not only going to pass legislation that will severely damage the balance of power established in the Constitution by our founding fathers, but it is going to go about in a manner that violates Article 1, Section 7 of the Constitution. Among other things, that article provides for each law passed by both the House of Representatives and the Senate to be then sent to the President for his signature. The key word here is “passed”. It appears that there are not enough votes in the House to pass the Senate version of the health care bill so House Speaker Nancy Pelosi will continue to show her distain for both the American people and the Constitution by ignoring Article 1, Section 7 of one of our most sacred documents and send the bill to the President for his signature without an actual vote on it in the House.

Instead she will use something being referred to as the “Slaughter Solution” named after Louise Slaughter, a member of the House from upstate New York who proposed that the idea be used to avoid a formal vote. This is also referred to as the “self executing” or “deeming” rule. The members of Congress will be allowed to vote to change the rules and authorize Pelosi to deem the Senate version of the Bill passed and send it to Obama to be signed into law. The fact that this ploy has been used in the past with other much less important legislation does not make it Constitutional. This action also allows the members of Congress to avoid another “troublesome” provision of our Constitution, Article 1, Section 5, that allows one fifth of the members of the House present to demand that the vote on any piece of legislation be recorded so the American people can know how their elected representatives voted.

The theory is that members of the House who live in districts where the majority of people oppose the health care legislation can go back to their districts and say that they did not vote for the bill. Instead, they will have just voted for a rule change. Of course, this ruse also makes the elitist assumption that “we the people” are too dumb to know that a vote to change the rules to allow the health care bill to go forward is the same as a direct vote for the legislation. By the way, if you want to read the new version of this legislation, forget it. Even though the vote to send it to Obama is scheduled to take place in just a few days, the text of the bill has not yet been made available to members of Congress or the American people.

The magnitude of this is almost incomprehensible. Nancy Pelosi and the leadership in the House of Representatives are telling us four things.
  • First and foremost, we are being told that members of Congress will no longer abide by the Constitution of the United States and are thereby violating their oath of office.
  • Second, members of Congress will no longer be representing the will of the American people who elected them but instead are representing the will of President Obama and his vision of a socialist America.
  • Third, members of Congress are done with allowing the American people to even participate in the process. Everything will be done in secret and your right to know what is being done to you will be ignored.
  • Last, but not least, members of Congress have concluded that we are not bright enough to know what is happening anyway so they think we will reelect them and be grateful for all they have done for us.
I just have this to say to President Obama, Nancy Pelosi, Harry Reid, and the other current “leaders” of our country. Over 230 years ago an English King and Parliament made similar assumptions about a group of people who called themselves Americans. Those assumptions were wrong and things did not end well for those who underestimated the passion of Americans to be a free people. If you continue on this course it will not end well for you either. To this I pledge my life, my fortune, and my sacred honor, as did my forefathers before me.

It is not too late to stop this abomination. Contact members of Congress now and tell them that you are not fooled and consider a vote for the Slaughter Solution to be a vote for the unconstitutional health care bill. You should further inform them that you consider such a vote to be a violation of their oath of office to uphold the Constitution of the United States and you will hold them accountable on Election Day.

For my part, I talked to Gary Kreep at the U.S. Justice Foundation today and we are already preparing the lawsuit that will challenge the Constitutionality of the passage of the health care bill under the “Slaughter Solution” and on other Constitutional grounds. If you want to contribute to this effort you can go to the U.S. Justice Foundation Website at: www.usjf.net. The fight to defend our freedom is not over, it is just beginning.

The Libertarian Party Opposes Health Care Plan - By Wes Benedict

WASHINGTON - The Libertarian Party adamantly opposes the health care bill passed on Christmas Eve by the US Senate that is currently being considered in the US House of Representatives. The Libertarian Party calls on the US House to vote down this disastrous plan, and instead to pass laws reducing federal involvement in health care.

Libertarian Party Chairman William Redpath commented, "We oppose this horrible federal government expansion into health care, just as we have consistently opposed all the increased government intrusion into health care proposed by Republicans and Democrats over the years. For example, we vocally opposed the huge Medicare expansion pushed through Congress by Republicans in 2003."

Redpath continued, "It is a virtual certainty that the cost estimates of this legislation are drastically understated. When Medicare Part A started in 1965, the projected cost for 1990 was $9 billion. It turned out to be $67 billion. Should this bill become law, when the debt of the United States government is downgraded by ratings agencies shortly thereafter, it will not be a coincidence. That will increase interest rates, and the entire economy will suffer."

The Libertarian Party Platform says the following about health care: "We favor restoring and reviving a free market health care system. We recognize the freedom of individuals to determine the level of health insurance they want, the level of health care they want, the care providers they want, the medicines and treatments they will use and all other aspects of their medical care, including end-of-life decisions."

The words "health care" and "medicine" are not found anywhere in the Constitution. Accordingly, the Libertarian Party asserts that Congress has no authority to regulate or appropriate money for health care. (The Libertarian Party has consistently argued for decades that the "general welfare" and "interstate commerce" clauses are not generic authorizations for spending and regulation.)

Redpath concluded, "This is a top-down, Washington-mandated control of health insurance and health care in this nation. It is the antithesis of consumer-driven health care, which is what will ultimately be necessary to control health care costs and to provide the best health care for the greatest number of people."

  Libertarians In The News:
Citizens Group CRAG Growing With Eye On City Spending, Taxes - By Sara Castellanos

AURORA | Transparency, accountability and efficiency in local government are top priorities for a group of taxpayers in Aurora, and they're letting the Aurora City Council know it.

The Citizens for Responsible Aurora Government originally began with a handful of residents opposed to the city council's ballot initiative that would have levied property taxes to fund the city's library system.

Now, CRAG has grown to more than 50 members, some of whom have avidly opposed the Horizon Uptown project, and others who have worked to obtain public records of city employees' salaries.

"Most of us are from different political persuasions," said CRAG member Rob McNealy, who is a Libertarian candidate for Colorado's 6th Congressional District. "It's a mixed group of people, and we come together on issues that are in all our best interests. We want government to be run well and we want government money to be spent wisely."

The group started in August 2009 with about 12 members including Jim Frye, who ran for a state House seat as a Libertarian in 2008.

They were against ballot measure 4A, which would have created a new general improvement district to fund Aurora's library system, and would have increased property taxes.

Voters eventually rejected the ballot initiative last November, and four local library branches closed soon after.

"We all knew some like-minded folks that didn't think that was a good idea, and we opposed it," Frye said. "After the election, we sat down and decided to continue and work on other projects."

Earlier this year Frye led a project that acquired the public records of city employees' salaries -- information that is not easily accessible, Frye said.

The salaries have been posted on CRAG's website, and members have said that city staff's salaries are higher than average and if they were decreased, it would help to close Aurora's budget deficit, which is currently about $9 million.

City budget officials said employees took voluntary furloughs last year that amounted in $200,000 in savings, and will be required to take two mandatory furlough days this year, which will result in $1 million in savings.

Most recently, CRAG members opposed the $1.7 billion Horizon Uptown project, saying city council shouldn't declare agricultural farmland blight and create a Tax Increment Financing district to help fund the project.

Despite their vocal opposition at a public hearing, city council members voted to declare the land blight, but Frye said CRAG members are still proud of their work.

"We think we've been successful in one way, which is that we've raised the Tax Increment Financing issue and blighting of inappropriate land," he said.

Their next goal is to try turning Aurora's closed libraries into computer centers. Since not all members agree on all projects, only one-third of CRAG members will be working on the computer center project, said McNealy.

CRAG currently has 54 members, and is still recruiting more people.

"It's interesting that with a relatively few number of citizens actively involved, what we've been able to accomplish," said member Larry Weygand. "If we had greater numbers, look at the potential that we could achieve."

For the first time in years, the Libertarian Party of Colorado is fielding more than one candidate in top-tier races.

The party nominated candidates when it held its state convention over the weekend.

Two Libertarians are running in each race for governor, U.S. Senate and Congressional District 1. That means Liberterians will have a primary, along with Republicans and Democrats, and go to the polls Aug. 10 to pick winners in those races.

That's big news for a party that two years ago didn't even nominate a U.S. Senate candidate, said Norm Olsen, campaign director for the Libertarians.

The candidates running in the contested races are: Jaimes Brown and Dan "Kilo" Sallis for governor; John Finger and Mac Stringer for U.S. Senate; and Clint Jones and Jeffrey Schitter for congress in the 1st District.
