REQUIREMENTS FOR AMENDMENT
PURPOSE: To expressly prevent the kind of dilatory nonsense attempted at the 2008
National Convention over the Statement of Values.

Section 1: Except as otherwise provided hereunder, this Constitution may be amended at

All changes to the Constitution of this Party, no matter how trivial, should, at minimum, be ratified by a vote of the legislative body of this Party, these Conventions.
There is no reason why this body cannot spend the few minutes to ratify those changes that the Board, in its wisdom, has temporarily made to the Constitution of this party because it has determined that it has found a technical error.
Nonetheless, as a matter of protocol and sound policy, it is these Conventions from which the Board derives its power, and it is these Conventions that should hold sole sovereignty over changes to its Constitution; no matter how trivial.
On a practical level, proponents of this change argue that it is a waste of these Conventions? time to argue about trivial changes to grammar.. This minority report makes two counter arguments. First, have we ever spent huge amounts of time revising the minutes of a previous Convention without substantive reason? Second ? should this amendment be adopted ? those who wish to argue for changes will have to submit an amendment and the business meeting may very well be adjourned prior to addressing the, possibly necessary, change.
Many of us are familiar with our own state and federal courts abuse of ?compelling state interest?, ?interstate commerce?, and ?substantial compliance? to further the aims of ever-growing government. Let us not invest our Board with powers that can be abused without further oversight. Let us not give our Board the authority to make changes ?as may be necessary to reflect the intent of the Delegates?. Those changes should, at minimum, be ratified by us, the Delegates at Convention, in order to certify our intent.
MINORITY REPORT REGARDING PROPOSED ARTICLE VIII, SECTION 5

Article VIII, Section 5, Paragraph (a) should read:
(a) submitting a letter of intent to the Board no later than sixty (60)
days before the Convention business session convenes, which shall
include the prospective candidate's contact information, qualifications,
and responses to a candidate questionnaire to be published
electronically by the Campaigns Director no later than
one-hundred-twenty (120) days before the Convention; all letters of
intent received by the Board by the sixty-day deadline shall be included
with the Call of the Convention.
